Terms of Service

1. Agreement to Terms

By accessing and using the services provided by Vital Care ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use our services.

2. Service Eligibility

Our services are designed for NDIS participants and their authorized representatives. To access our services, you must:

  • Be an NDIS participant with an approved plan, or
  • Be an authorized representative of an NDIS participant
  • Reside within our service area (Alice Springs and surrounding NT areas)
  • Be legally able to enter into this agreement

3. Services Provided

Vital Care provides NDIS-funded support services including:

  • Community nursing care
  • Daily living skills development
  • Travel and transport assistance
  • Group and centre-based activities
  • Community participation support

All services are delivered in accordance with NDIS Practice Standards and your individual NDIS plan.

4. Participant Responsibilities

As a participant or representative, you agree to:

  • Provide accurate information about support needs
  • Treat our staff with respect and dignity
  • Provide reasonable notice for cancellations (30 days)
  • Maintain a safe environment for service delivery
  • Inform us of changes to your circumstances or needs

5. Payment Terms

Services are charged in accordance with NDIS Price Guides. Payment arrangements depend on your plan management type:

  • NDIA-managed: We claim directly from the NDIA
  • Plan-managed: We invoice your plan manager
  • Self-managed: We provide invoices for your reimbursement

6. Cancellation Policy

We require 30 days notice for cancellations. Cancellations with less notice may incur cancellation fees. Emergency cancellations will be considered on a case-by-case basis.

7. Liability Limitations

While we take all reasonable care in providing our services:

  • We are not liable for matters beyond our reasonable control
  • Our liability is limited to the extent permitted by Australian law
  • We maintain appropriate insurance coverage
  • Nothing in these terms excludes consumer guarantees under Australian Consumer Law

8. Termination

Either party may terminate services with 14 days written notice. Immediate termination may occur if:

  • Safety concerns arise for staff or participants
  • There is a material breach of these terms
  • NDIS funding is no longer available

9. Complaints & Disputes

We are committed to resolving complaints fairly. If you have a concern:

  1. Contact us directly to discuss the issue
  2. Submit a formal complaint if not resolved
  3. Contact the NDIS Quality and Safeguards Commission if needed

10. Governing Law

These terms are governed by the laws of the Northern Territory, Australia. Any disputes will be subject to the exclusive jurisdiction of courts in the Northern Territory.
